Physical and mental training are associated with positive effects on executive functions throughout the lifespan. However, evidence of the benefits of combined physical and mental regimes over a sedentary lifestyle remain sparse. The goal of this study was to investigate potential mechanisms, from a source-resolved event-related-potential perspective, that could explain how practicing long-term physical and mental exercise can benefit neural processing during the execution of an attention switching task. Fifty-three healthy community volunteers who self-reported long-term practice of Tai Chi, meditation (...) + exercise, simple aerobics, or a sedentary lifestyle, aged 47.8 ± 14.6 were included in this analysis. All participants undertook high-density electroencephalography recording during a switch paradigm. Our results indicate that people who practice physical and mental exercise perform better in a task-switching paradigm. Our analysis revealed an additive effect of the combined practice of physical and mental exercise over physical exercise only. In addition, we confirmed the participation of frontal, parietal and cingulate areas as generators of event-related-potential components commonly associated to the performance of switch tasks. Particularly, the N2-like component of the parietal and frontal domains showed significantly greater amplitudes in the exercise and mental training groups compared with aerobics and sedentary groups. Furthermore, we showed better performance associated with greater N2-like amplitudes. Our multivariate analysis revealed that activity type was the most relevant factor to explain the difference between groups, with an important influence of age, and body mass index, and with small effects of educational years, cardiovascular capacity, and sex. These results suggest that chronic combined physical and mental training may confer significant benefits to executive function in normally aging adults, probably through more efficient early attentional processing. Future experimental studies are needed to confirm our results and understand the mechanisms on parieto-frontal networks that contribute to the cognitive improvement associated with practicing combined mental and aerobic exercise, while carefully controlling confounding factors, such as age and body mass index. As physicians encounter an increasingly diverse patient population, socioeconomic circumstances, religious values and cultural practices may present barriers to the delivery of quality care. Increasing cultural competence is often cited as a way to reduce healthcare disparities arising from value and cultural differences between patients and providers. Cultural competence entails not only a knowledge base of cultural practices of disparate patient populations, but also an attitude of adapting one's practice style to meet patient needs and values. Gender roles, relationship dynamics (...) and boundaries are culture specific, and are frequently shaped by religious teachings. Consequently, religion may be conceptualised as a cultural repertoire, or dynamic tool-kit, by which members of a faith adapt and negotiate their identity in multicultural societies. The manner in which Islamic beliefs and values inform Muslim healthcare behaviours is relatively under-investigated. In an effort to explore the impact of Islam on the relationship between patients and providers, we present an Islamic bioethical perspective on cross-gender relations in the patient-doctor relationship. We will begin with a clinical scenario highlighting three areas of gender interaction that bear clinical relevance: dress code, seclusion of members of the opposite sex and physical contact. Next, we provide a brief overview of the foundations of Islamic law and ethical deliberation and then proceed to develop ethicolegal guidelines pertaining to gender relations within the medical context. At the end of this reflection, we offer some practice recommendations that are attuned to the cultural sensitivities of Muslim patient populations. (shrink)

Paraconsistent approaches have received little attention in the literature on vagueness (at least compared to other proposals). The reason seems to be that many philosophers have found the idea that a contradiction might be true (or that a sentence and its negation might both be true) hard to swallow. Even advocates of paraconsistency on vagueness do not look very convinced when they consider this fact; since they seem to have spent more time arguing that paraconsistent theories are at least as (...) good as their paracomplete counterparts, than giving positive reasons to believe on a particular paraconsistent proposal. But it sometimes happens that the weakness of a theory turns out to be its mayor ally, and this is what (I claim) happens in a particular paraconsistent proposal known as subvaluationism. In order to make room for truth-value gluts subvaluationism needs to endorse a notion of logical consequence that is, in some sense, weaker than standard notions of consequence. But this weakness allows the subvaluationist theory to accommodate higher-order vagueness in a way that it is not available to other theories of vagueness (such as, for example, its paracomplete counterpart, supervaluationism). What should our theorizing about social justice aim at? Many political philosophers think that a crucial goal is to identify a perfectly just society. Amartya Sen disagrees. In The Idea of Justice, he argues that the proper goal of an inquiry about justice is to undertake comparative assessments of feasible social scenarios in order to identify reforms that involve justice-enhancement, or injustice-reduction, even if the results fall short of perfect justice. Sen calls this the “comparative approach” to the theory of (...) justice. He urges its adoption on the basis of a sustained critique of the former approach, which he calls “transcendental.” In this paper I pursue two tasks, one critical and the other constructive. First, I argue that Sen’s account of the contrast between the transcendental and the comparative approaches is not convincing, and second, I suggest what I take to be a broader and more plausible account of comparative assessments of justice. The core claim is that political philosophers should not shy away from the pursuit of ambitious theories of justice (including, for example, ideal theories of perfect justice), although they should engage in careful consideration of issues of political feasibility bearing on their practical implementation. A group of philosophers suggests that a sense of mineness intrinsically contained in the phenomenal structure of all conscious experiences is a necessary condition for a subject to become aware of himself as the subject of his experiences i.e. self-awareness. On this view, consciousness necessarily entails phenomenal self-awareness. This paper argues that cases of delusions of thought insertion undermine this claim and that such a phenomenal feature plays little role in accounting for the most minimal type of self-awareness entailed by (...) phenomenal consciousness. First, I clarify the main view endorsing this claim i.e. the Self-Presentational View of Consciousness and formulate the challenge from thought insertion. After, I offer a systematic evaluation of all the strategies used by the advocates of this view to deal with this challenge. Finally, I conclude that most of these strategies are unsatisfactory for they rest in unwarranted premises, imprecisions about the agentive nature of cognitive experiences, and especially, lack of distinction between the different ways in which subjects can become aware of their own thoughts. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. Substructural approaches to paradoxes have attracted much attention from the philosophical community in the last decade. In this paper we focus on two substructural logics, named ST and TS, along with two structural cousins, LP and K3. It is well known that LP and K3 are duals in the sense that an inference is valid in one logic just in case the contrapositive is valid in the other logic. As a consequence of this duality, theories based on either logic are (...) tightly connected since many of the arguments for and objections against one theory reappear in the other theory in dual form. The target of the paper is making explicit in exactly what way, if any, ST and TS are dual to one another. The connection will allow us to gain a more fine-grained understanding of these logics and of the theories based on them. In particular, we will obtain new insights on two questions concerning ST which are being intensively discussed in the current literature: whether ST preserves classical logic and whether it is LP in sheep’s clothing. Explaining in what way ST and TS are duals requires comparing these logics at a metainferential level. We provide to this end a uniform proof theory to decide on valid metainferences for each of the four logics. This proof procedure allows us to show in a very simple way how different properties of inferences (unsatisfiability, supersatisfiability and antivalidity) that behave in very different ways for each logic can be captured in terms of the validity of a metainference. Is democracy a human right? There is a growing consensus within international legal and political practice that the answer is “Yes.” However, some philosophers doubt that we should see democracy as a human right. In this paper I respond to the most systematic challenge presented so far, which was recently offered by Joshua Cohen. His challenge is directed to the view that democracy is a human right, not to the view that democracy is part of what justice demands. It is (...) instructive because it forces us to consider important questions about the nature and justification of human rights, including the putative human right to democracy. There is a tendency to see every claim of justice as a human right, and Cohen presses us to face the risk that this slip may occur in the case of democracy. Thus my aim is not simply to refute Cohen’s arguments but to engage the questions he forcefully and helpfully puts on the table. I start in section 2 by analyzing Cohen’s account of human rights. In section 3 I defend the human right to democracy against his challenge. I conclude in section 4 by articulating some reasons for the claim that democracy is a human right that mobilize and elaborate on some of Cohen’s own key premises. (shrink)

In this paper I discuss the problem of scientific laws in general and laws of biology in particular. After reviewing the debate about the existence of laws in biology, I examine the subject under the light of the structuralist notion of a fundamental law and argue for the law of matching as the fundamental law of genetics.

To be justifiable, the demands of a conception of human rights and global justice must be such that (a) they focus on the protection of important human interests, and (b) their fulfilment is feasible. I discuss the feasibility condition. I present a general account of the relation between moral desirability, feasibility and obligation within a conception of justice. I analyse feasibility, a complex idea including different types, domains and degrees. It is possible to respond in various ways if the fulfilment (...) of basic socioeconomic human rights against severe poverty seems at first to be infeasible. (shrink)

A salient feature of de Broglie-Bohm quantum theory is that particles have determinate positions at all times and in all physical contexts. Hence, the trajectory of a particle is a well-defined concept. One then may expect that the closely related notion of inertial trajectory is also unproblematically defined. I show that this expectation is not met. I provide a framework that deploys six different ways in which dBB theory can be interpreted, and I state that only in the canonical interpretation (...) the concept of inertial trajectory is the customary one. However, in this interpretation the description of the dynamical interaction between the pilot-wave and the particles, which is crucial to distinguish inertial from non-inertial trajectories, is affected by serious difficulties, so other readings of the theory intend to avoid them. I show that in the alternative interpretations the concept at issue gets either drastically altered, or plainly undefined. I also spell out further conceptual difficulties that are associated to the redefinitions of inertial trajectories, or to the absence of the concept. (shrink)

Synthetic biology, an emerging field of science and technology, intends to make of the natural world a substrate for engineering practice. Drawing inspiration from conventional engineering disciplines, practitioners of synthetic biology hope to make biological systems standardized, calculable, modular, and predictably functional. This essay develops a Heideggerian reading of synthetic biology as a useful perspective with which to identify and explore key facets of this field, its knowledge, its practices, and its products. After overviews of synthetic biology and Heidegger’s account (...) of technology, I discuss calculability, utility, function, setting-upon, and ordering, with the aim of discussing the manner in which synthetic biology works to render the biological world intelligible as something to be used, rather than something that is in and of itself. Having developed this Heideggerian reading, I proffer a number of corrections to his account that enable a more accurate, nuanced understanding of synthetic biology. Specifically, I discuss the notion of Ge-stell and submit that multiple systems of “enframing” may help to make Heidegger’s argument more robust. I suggest that synthetic biology may work to reveal the natural world as a standing-reserve of function. (shrink)

It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. Self-injurious behavior is associated with diverse psychiatric conditions. Sometimes, SIB is the most dominant symptom, severely restricting the psychosocial functioning and quality of life of the patients and inhibiting appropriate patient care. In severe cases, it can lead to permanent physical injuries or even death. Primary therapy consists of medical treatment and if implementable, behavioral therapy. For patients with severe SIB refractory to conventional therapy, neuromodulation can be considered as a last recourse. In scientific literature, several successful lesioning and deep (...) brain stimulation targets have been described that can indicate a common underlying neuronal pathway. The objectives of this study were to evaluate the short- and long-term clinical outcome of patients with severe, therapy refractory SIB who underwent DBS with diverse underlying psychiatric disorders and to correlate these outcomes with the activated connectivity networks. We retrospectively analyzed 10 patients with SIB who underwent DBS surgery with diverse psychiatric conditions including autism spectrum disorder, organic personality disorder after hypoxic or traumatic brain injury or Tourette syndrome. DBS targets were chosen according to the underlying disorder, patients were either stimulated in the nucleus accumbens, amygdala, posterior hypothalamus, medial thalamus or ventrolateral thalamus. Clinical outcome was measured 6 months after surgery and at long-term follow-up after 10 or more years using the Early Rehabilitation Barthel index and time of restraint. Connectivity patterns were analyzed using normative connectome. Based on previous literature the orbitofrontal cortex, superior frontal gyrus, the anterior cingulate cortex, the amygdala and the hippocampus were chosen as regions of interest. This analysis showed a significant improvement in the functionality of the patients with DBS in the short- and long-term follow-up. Good clinical outcome correlated with higher connectivity to the amygdala and hippocampus. These findings may suggest a common pathway, which can be relevant when planning a surgical procedure in patients with SIB. (shrink)

Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. Social studies of knowledge have contributed many insights into the making and the character of scientific and technological knowledge. However, studies of knowledge use are scarce. This article engages with under-examined topics concerning epistemic utility. I posit and demonstrate that scientific and technological knowledge claims are functional. I argue that knowledge and its functions are mutually-enabling and mutually-sustaining constructs. To substantiate my claims, I present useful conceptualisations of ‘function’ and ‘functionality’ and employ them in an empirical case study. I examine (...) knowledge use in synthetic biology, a young form of biological engineering. I demonstrate that knowledge in the field is brought into existence with function in mind, kept in existence through functional use, qualified and situated by its functionality and evaluated by its functional operation. The case study reveals the effectiveness of my conceptualisations and offers lessons about knowledge as both an end-result of epistemic work and a mechanism for practice. My theoretical and empirical contributions expand understanding of scientific and technological knowledge and shed light on an area of study awaiting investigation. I conclude with open-ended reflections on work yet to be done. (shrink)

A commitment to ‘making’—creating or producing things—can shape scientific and technological fields in important ways. This article demonstrates this by exploring synthetic biology, a field committed to making use of advanced techniques from molecular biology in order to make with living matter. I describe and analyse how this field’s ‘drive to make’ shapes its organisational, methodological, epistemological, and ontological character. Synthetic biologists’ ambition to make helps determine how their field demarcates itself, sets appropriate methods and practices, construes the purpose and (...) character of knowledge, and views the things of the living world. Using empirical data from extensive ethnographic and interview-based research, I discuss the importance of seemingly simple and unimportant commitments—in this case, a focus on the making of things rather than the production of knowledge claims. I conclude by examining the ramifications of this line of research for studies of science and technology. (shrink)

In 2006, this journal addressed the problem of technological artefacts, and through a series of articles aimed at tackling the ‘dual nature of technical artefacts’, posited an understanding of these as constituted by both a structural and a functional component. This attempt to conceptualise artefacts established a series of important questions, concerning such aspects of material technologies as mechanisms, functions, human intentionality, and normativity. However, I believe that in establishing the ‘dual nature’ thesis, the authors within this issue focused too (...) strongly on technological function. By positing function as the analytic axis of the ‘dual nature’ framework, the theorists did not sufficiently problematise what is ultimately a social phenomenon. Here I posit a complementary analytic approach to this problem; namely, I argue that by using the Strong Programme’s performative theory of social institutions, we can better understand the nature of material technologies. Drawing particularly from Martin Kusch’s work, I here argue that by conceptualising artefacts as artificial kinds, we can better examine technological ontology, functions, and normativity. Ultimately, a Strong Programme approach, constructivist and collectivist in nature, offers a useful elaboration upon the important question raised by the ‘dual nature’ theorists.Keywords: Technological artefacts; Dual nature; Technological functions; Normativity of artefacts; Performative theory of social institutions. Canguilhem’s take on the normal and the pathological offers an interesting insight to elaborate on a phenomenological account of illness and the medical encounter within the scope of Heidegger’s Daseinanalysis from Being and Time. Fredrik Svenaeus has drawn from the latter a definition of illness as an “unhomelike being in the world”. In this paper, I will elaborate on these concepts through the tale of Adriana, a cancer fighter that got diagnosed at age 26. Through her story, I will try (...) to illustrate Canguilhem’s main criticism against medicine's current state, as well as describe phenomenologically what it means to be ill, and what illness does to the patient's being-in-the-world. Different conceptions of scientific theories, such as the state spaces approach of Bas van Fraassen, the phase spaces approach of Frederick Suppe, the set-theoretical approach of Patrick Suppes, and the structuralist view of Joseph Sneed et al. are usually put together into one big family. In addition, the definite article is normally used, and thus we speak of the semantic conception of theories and of its different approaches . However, in The Semantic Conception of Theories and Scientific Realism , starting (...) from certain remarks already made in “Theory Structure” , Current Research in Philosophy of Science, East Lansing: Philosophy of Science Association, 1979, pp. 317–338), Frederick Suppe excludes the structuralist view as well as other “European” versions from the semantic conception of theories. In this paper I will critically examine the reasons put forward by Suppe for this decision and, later, I will provide a general characterization of the semantic family and of the structuralist view of theories in such a way as to justify the inclusion of the structuralist view as a member of this family. In this introductory study I discuss the notion of alternative possibilities and its relation to contemporary debates on free will and moral responsibility. I focus on two issues: whether Frankfurt-style cases refute the principle of alternative possibilities, and whether alternative possibilities are relevant to grounding free will and moral responsibility. With respect to the first issue, I consider three objections to Frankfurt-syle cases: the flicker strategy, the dilemma defense, and the objection from new dispositionalism. With respect to the second issue, (...) I consider the debate between Alternative Possibilities views and Actual Sequence views, as framed by Carolina Sartorio in her Causation and Free Will. I then explain how these two issues are relevant to the papers included in this volume. (shrink)

The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the analysis (...) (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. In this dissertation, I argue that we should reframe the presentation and defense of the program of discourse ethics and deliberative democracy (DEP) in such a way that we make clear its connection to the substantive moral ideas of solidarity, equality and freedom. This program basically says that we should, when we can, determine the validity of the norms regulating our social life through practices of public deliberation. If we want to understand why engaging in public deliberation makes moral sense, (...) or is obligatory, we need to make explicit the connection between the formal procedures of deliberation and our most basic substantive moral ideas of freedom, equality and solidarity. In order to unpack this claim, I construct what I call an expressive-elaboration model of the relation between substance and procedure in public deliberation. According to this model, we should see the two dimensions as working in tandem, in such a way that deliberative procedures are understood as the medium of expression and elaboration of our basic substantive ideas of solidarity, equality and freedom. The three ideas are expressed in the fact and form of deliberation, and elaborated in their changing and specific interpretations as topics and consequences of deliberative practices. To develop this model, I start with a consideration of certain insights of Kant's moral theory, and proceed to bridge the gap between Habermas's more formalistic and Rawls's more substantive neo-Kantian accounts of practical reason. The result is a straightforwardly substantive articulation and defense of the dialogic procedures of DEP based on the recognition of the fact of widespread moral disagreement and a fundamental project of justice demanding that we deal with that condition of disagreement by constructing social arrangements in which we include each other, solidaristically, as free and equal members. This morally substantive defense of DEP referring to the fact of widespread moral disagreement and the fundamental project of justice is different from, and more compelling than, other common, formalistic and prudential defenses of DEP. The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. In World Poverty and Human Rights, Thomas Pogge argues that the global rich have a duty to eradicate severe poverty in the world. The novelty of Pogges approach is to present this demand as stemming from basic commands which are negative rather than positive in nature: the global rich have an obligation to eradicate the radical poverty of the global poor not because of a norm of beneficence asking them to help those in need when they can at little cost (...) to themselves, but because of their having violated a principle of justice not to unduly harm others by imposing on them a coercive global order that makes their access to the objects of their human right to subsistence insecure. In this paper, I claim that although Pogge is right in arguing that negative duties are crucial in an account of global justice, he is wrong in saying that they are the only ones that are crucial. Harming the global poor by causing their poverty provides a sufficient but not a necessary condition for the global rich to have a duty of justice to assist them. After engaging in a critical analysis of Pogges argument, I conclude by suggesting the need for a robust conception of cosmopolitan solidarity that includes positive duties of assistance which are not mere duties of charity, but enforceable ones of justice. In this paper, I argue that both perdurance theory and the ‘relations-to-times’ endurantist view rely on an atemporal notion of property instantiation and relation bearing. I distinguish two possible meanings of ‘atemporal’ which result in two different understandings of what it is for an object to have a property or to bear a relation atemporally. I show that standard presentations of the theories considered are indeterminate as to which of these two understandings is the intended one. Since its early origins, just war discourse has had two contrasting functions: it has sought to speak law and morals to power, and thus to restrain the use of force, but it has also served to authorize and legitimize the use of force. Critical voices have recently alerted to the increasing use of authorization and legitimization in a broader context of hegemonic and unilateral appropriations of just war discourse. In this article, I show that such critiques of just war have (...) a long history, and reconstruct the powerful challenge that two of the foremost international jurists of the Enlightenment—Christian Wolff and Emer de Vattel—mounted against early modern accounts of just war. Their neglected theory of “regular war” helps us to recover a sense of what a truly pluralist and anti-hegemonic doctrine of ius ad bellum may look like, and reveals a deep tension in the just war tradition between the criteria of political authority and just cause. One of the most intriguing bio-objects in the emerging field of regenerative medicine is umbilical cord blood. Employed in existing haematological therapies, but also loaded with potentialities for future uses, cord blood has been lately the focus of a regulatory debate which confronts public and private forms of biobanking. This article explores the political and anthropological side of this debate, describing the ways in which different health practices related to the umbilical cord (and to its symbolic sibling, the placenta) have (...) been involved in processes of societal production and reproduction. Through the use of ethnological and historical data, and their comparison with current practices, I contend that the technical manipulation of cords and placentas goes much longer into the past than what a first glance suggests, and that these two objects can be understood as biological spaces in which forms of social belonging and versions of the societal bond are at play. The current conflict between public and private cord blood banks is therefore interpreted as part of a longer history of bodily practices, and as reflecting recent mutations in the biopolitical constitution of advanced liberal societies. In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments proposed (...) by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. The bridge between psychiatry and neuroscience is not the only one we have to build; it is also necessary to narrow the gap between neuroscience and philosophy. This does not imply reducing the latter to the former or vice versa, but rather linking each other without eliminating their own characteristics. Taking that into account, Dan Zahavi’s phenomenology of mind can make a great contribution by presenting itself like a different option within philosophy of mind, which up until the last few (...) years was dominated by the analytic tradition. In this chapter I present Zahavi’s proposal in four steps. Firstly, I clarify the term phenomenology. This question is not accidental because nowadays this concept is used by diverse traditions and with different meanings. Secondly, I make the fundamental distinction between first-person-perspective—which corresponds to Phenomenology—and third-person-perspective—compatible with neuroscience. Thirdly, I explain the methodological stages assumed by Zahavi from the Husserlian tradition. These stages enable him to study from the first-person-perspective rigorously: epoché, phenomenological reduction, eidetic variation, and intersubjective verification. Finally, I develop the issue of naturalization of Phenomenology in order to establish a dialogue between science and philosophy. For Zahavi that naturalization does not necessarily imply reductionism, but can be understood as something necessary for a fruitful exchange between those disciplines. (shrink)

The idea of dignity is pervasive in political discourse. It is central to human rights theory and practice, and it features regularly in conceptions of social justice as well as in the social movements they seek to understand or orient. However, dignity talk has been criticized for leading to problematic exclusion. Critics challenge it for undermining our recognition of the rights of non-human animals and of many human individuals (such as children, the elderly, and people with disabilities). I argue that, (...) on a plausible articulation of it, the idea of dignity does not lead to these exclusions and that it in fact helps defend an appropriately inclusive moral and political treatment of all individuals. Difficult issues about equality and diversity indeed arise, but a dignitarian approach can provide good answers to them or at least help make them clearer and more tractable. (shrink)

The aim of this paper is to propose a model for understanding the relation between substance and procedure in discourse ethics and deliberative democracy capable of answering the common charge that they involve an ‘empty formalism’. The expressive-elaboration model introduced here answers this concern by arguing that the deliberative practical rationality presupposed by discourse ethics and deliberative democracy involves the creation of a practical medium in which certain general basic ideas of solidarity, equality and freedom are expressed and elaborated in (...) the context of widespread moral disagreement. In the course of this paper I propose an elucidation of these ideas and argue for the thesis that they are internally related to the endorsement of deliberative practical rationality. The three basic substantive ideas contribute to the determination of the existence, the form, the topics and intended outcomes, and the effects of the practice of public deliberation. This amounts to an elucidatory defense of deliberative practical rationality by explicating its substantive significance or point. This paper offers an exploration of the socialist principle “From each according to their abilities, to each according to their needs.” The Abilities/Needs Principle is arguably the ethical heart of socialism but, surprisingly, has received almost no attention by political philosophers. I propose an interpretation of the principle and argue that it involves appealing ideas of solidarity, fair reciprocity, recognition of individual differences, and meaningful work. The paper proceeds as follows. First, I analyze Marx’s formulation of the Abilities/Needs Principle. Second, (...) I identify the principle’s initial plausibility, but show that it faces serious problems that cannot be addressed without developing a fresh interpretation of it. Third, I provide an interpretation of the principle that highlights demands concerning opportunities for self-realization in work, positive duties of solidarity, sensitivity to individual differences, and mechanisms of fair reciprocity. Fourth, I discuss a possible institutional implementation of the Abilities/Needs Principle. Finally, I identify some normative puzzles about the transition from capitalism to socialism, and suggest how the Abilities/Needs Principle might gain motivational traction by mobilizing the powerful idea of human dignity. The aim of this paper is to further develop van Fraassen’s diagnosis, expanding a previous analysis of the fundamental law of classical genetics and the status of the so-called ‘Mendel’s laws’.6 According to this diagnosis the Hardy-Weinberg law: 1) cannot be considered as axiom (or fundamental law) for classical population genetics, since it is a law that describes an equilibrium that 2) holds only under certain special conditions, and 3) only determines a subclass of models, 4) whose generalized form (and (...) fundamental law) being shading off into logical vacuity, and 5) more complex variants of the fundamental law (and of the Hardy-Weinberg law) can be “deduced” for more realistic assumptions. In order to achieve this, I will use notions of the structuralist view of theories, a version that is related to but different from that of van Fraassen’s. These are the notions of fundamental law, specialization, and special law. Having as a background a structuralist reconstruction of classical population genetics, I will show why the Hardy-Weinberg law should not be in fact considered the fundamental law of such a theory, but a special law (and not even a “terminal” specialization, i.e. a “non-terminal” specialization). Social scientific and humanistic research on synthetic biology has focused quite narrowly on questions of epistemology and ELSI. I suggest that to understand this discipline in its full scope, researchers must turn to the objects of the field—synthetic biological artifacts—and study them as the objects in the making of a science yet to be made. I consider one fundamentally important question: how should we understand the material products of synthetic biology? Practitioners in the field, employing a consistent technological optic in (...) the study and construction of biological systems, routinely employ the mantra ‘biology is technology’. I explore this categorization. By employing an established definition of technological artifects drawn from the philosophy of technology, I explore the appropriateness of attributing to synthetic biological artifacts the four criteria of materiality, intentional design, functionality, and normativity. I then explore a variety of accounts of natural kinds. I demonstrate that synthetic biological artifacts fit each kind imperfectly, and display a concomitant ontological ‘messiness’. I argue that this classificatory ambivalence is a product of the field’s own nascence, and posit that further work on kinds might help synthetic biology evaluate its existing commitments and practices. Israeli enforcement law uses both direct and indirect enforcement — the former via attachment of assets, and the latter via imprisonment of the debtor. The use of indirect enforcement via imprisonment is problematic, as it violates the basic rights of the debtor. I will argue that in response to this problem, the law created a framework for the "debtor of limited means." I will demonstrate that not only does this create an improper definition of the task of the Chief Enforcement (...) Officer, but that it is also an inefficient way of dealing with an insolvent debtor. I will propose that the system differentiate between debtors who cannot pay their debts and those who do not want to pay their debts. I believe that encouraging the insolvent debtor to file for of bankruptcy will avoid the problem of imprisonment and enable the Chief Enforcement Officer to return to his natural role as judge of enforcement. Additionally, I suggest creating a separate track of "consumer enforcement," which would avoid the whole system of installments, imprisonment, and debtors of limited means, at least regarding consumer credit. In the following essay I present a narrative of the development of astronomical models from Eudoxus to Kepler, as a case-study that vindicates an insightful and influential recent account of the concept of scientific understanding. Since this episode in the history of science and the concept of understanding are subjects to which Professor Roberto Torretti has dedicated two wonderful books—De Eudoxo a Newton: modelos matemáticos en la filosofía natural (2007), and Creative Understanding: philosophical reflections on physics (1990), respectively—this essay is (...) my contribution to celebrate his outstanding work and career in this volume. I dedicate this piece to Roberto, dear friend and mentor, in gratitude for all his inspirational work and personal support, which has greatly helped me, and many others, to better understand that human wonder we call scientific knowledge. The present article aims to inquire the negativity implied in the relation between man and nature in Kant’s early philosophy. This negativity will be treated from the realm of the theodicy as the dimension from where human fate can be posed. The characterization of this fate will be possible via ethical and aesthetic dimensions set out by Kant in his works dedicated to the subject of theodicy and philosophy of nature; i.e. Über Optimismus, which dates back to the 1750´s. Followingly, (...) we will discuss certain aspects of the author´s Universal History of Nature and Theory of Heaven, and thereafter we will refer ourselves to three minor works concerning earthquakes. In the last chapter we will point out how the comprehension of the aforementioned works are essential in order to define the sentiment of the sublime. In conclusion we will define the sublime as incompatible with optimism. (shrink)
